Who we are
BW Creative is a marketing studio operated by Bryce Walls, based in Huntington Beach, California ("we," "us," "our"). This Privacy Policy explains how we collect, use, share, and protect personal information when you visit bwcreative.org, fill out a form, take our social audit, or otherwise interact with us.
For any privacy-related question or request, contact us at bryce@bwcreative.org. This policy works alongside our Cookie Policy, which describes the specific cookies and tracking technologies we use.
Information we collect
We collect personal information in three ways:
1. Information you give us directly
When you submit a form (contact, book-a-call, free audit, or the social audit results gate), we collect the information you provide, which may include:
- Contact details — your name, email address, and any phone number, company name, or website you choose to share.
- Project details — anything you tell us about your business, goals, budget, or marketing needs in a message or form field.
- Audit responses — the answers you select in our interactive social audit, which we use to generate and email your personalized scorecard.
2. Information collected automatically
When you browse the site, we and our analytics/advertising partners automatically collect certain technical information through cookies and similar technologies, including:
- Device & usage data — IP address (often truncated/anonymized), browser type, device type, operating system, referring URL, pages viewed, and time spent on the site.
- Behavioral data — interactions such as clicks, scrolls, and conversions, collected via Google Analytics 4 and the Meta Pixel.
Non-essential analytics and advertising technologies only load after you consent via our cookie banner. See our Cookie Policy for the full list.
3. Information from third parties
If you reach us through an ad or a social platform, that platform (e.g., Meta or Google) may share limited campaign attribution data with us. If you book a call through our scheduling tool, that provider shares the booking details you submit.
How we use your information
We use personal information to:
- Respond to your inquiries and provide the services you request;
- Generate and deliver your social audit scorecard and related recommendations;
- Send you marketing emails, insights, and offers — only where permitted, and always with an unsubscribe option (see Your rights);
- Measure and improve our website, content, and advertising performance;
- Maintain the security and integrity of the site;
- Comply with legal obligations and enforce our Terms of Service.
Who we share information with
We do not sell your personal information. We share it only with the service providers that help us operate, in the categories below:
| Provider | Purpose | Data shared |
|---|---|---|
| Google (GA4) | Website analytics | Usage & device data, IP address |
| Meta Platforms | Advertising measurement & retargeting | Usage & conversion data |
| Klaviyo | Email marketing & list management | Name, email, audit results |
| FormSubmit | Form delivery to our inbox | Form contents you submit |
| Scheduling tool | Booking calls | Name, email, booking details |
Each provider processes data under its own privacy terms. We may also disclose information if required by law, to protect our rights, or in connection with a business transfer (e.g., merger or acquisition).
Legal basis for processing (GDPR)
If you are in the European Economic Area (EEA) or United Kingdom, we process your personal data on the following legal bases:
- Consent — for non-essential analytics and advertising cookies, and for marketing emails. You may withdraw consent at any time.
- Contract — to respond to and deliver services you request.
- Legitimate interests — to operate, secure, and improve our site, where those interests are not overridden by your rights.
- Legal obligation — where we must process data to comply with the law.
Data retention
We keep personal information only as long as necessary for the purposes described above. Form submissions and email-list data are retained until you ask us to delete them or unsubscribe. Analytics data follows the retention period configured in GA4 (currently 14 months). Our consent preference (bw-cookie-ok) stays in your browser's localStorage until you clear it.
Your rights & choices
Depending on where you live, you may have the right to access, correct, delete, or port your personal information, and to object to or restrict certain processing. To exercise any right, email bryce@bwcreative.org and we will respond within the timeframe required by applicable law.
- Email marketing. Every marketing email includes an unsubscribe link. You can opt out at any time, and we will stop sending marketing messages.
- Cookies. Manage or withdraw cookie consent through your browser settings, or via the controls described in our Cookie Policy.
- Analytics opt-out. Install the Google Analytics opt-out add-on.
California privacy rights (CCPA / CPRA)
If you are a California resident, you have the right to know what personal information we collect, to delete it, to correct it, to opt out of the "sale" or "sharing" of personal information, and to non-discrimination for exercising these rights. We do not sell your personal information. If your browser broadcasts a Global Privacy Control (GPC) signal, we treat it as a valid opt-out of sharing for cross-context behavioral advertising.
To submit a request, email bryce@bwcreative.org. We will respond within 45 days as required by law. You may designate an authorized agent to make a request on your behalf.
International data transfers
We are based in the United States, and our providers (including Google, Meta, and Klaviyo) process data on US servers. If you access the site from outside the US, your information may be transferred to and processed in the US, which may have different data-protection laws than your jurisdiction. Our providers maintain Standard Contractual Clauses and other safeguards as required by applicable law.
Children's privacy
This site is intended for business audiences and is not directed to children under 16. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.
Security
We use reasonable technical and organizational measures to protect personal information. The site is served over HTTPS, and we limit access to the data we collect. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.
Changes to this policy
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date above. Material changes will be reflected on this page; please review it periodically.
